I purchased a Honda City top end model car from HONDA showroom on 4th April 2011(Invoice no. 1398). The registration number is MH14 CS 0960 and the vehicle number is honda city vmt. I am facing problem with melting of car color (Urban Titanium) and have been trying to get the problem fixed but in all my attempts to do so the company’s service has been nothing but cursory, inefficient and inadequate. The problem started when few months back there were bird droppings on the bonnet of my car. On cleaning the bonnet (with plain water), I noticed a unique problem that the complete layer of color had melted and shrunk. Also the color has now started coming out. I understand that at times due to bird droppings the color may fade as the dropping has acidic content in it but melting of the color is unjustifiable. I promptly reported the matter to the General Manger- Deccan Honda (BAFNA AUTO India Private Limited) who in his reply stated that the company was in no position to help and I would have to bear the burden of repainting the bonnet. The cost of repainting the bonnet would be somewhere between 12,000/- to 15,000/-. My question is that how many times I will have to paint the car as bird dropping is a common phenomenon. Also I own a Hyundai car and never faced such a situation despite the bird droppings on it too. I have spent lot of money, time and energy in buying the car and it infuriates me that I was handed a faulty car and hence asked to repaint the car at the money cost. Further, I want to state that I stand on firm legal grounds based on National Commission’s judgement in a case against the company. Honda Siel Cars India Limited. The National Commission held that if the paint on the car either fades away, or chips off within the warranty period of the car, it amounts to a deficiency in services. The seller cannot rely upon the fact that the purchaser may have used an abrasive mode of cleaning the car without any proof of such method being out of the course of ordinary maintenance of the car. The Commission held that the aggrieved purchaser was entitled to a repainting of the car, fresh issuing of warranty in respect of re-finishing of paint, and compensation of Rs.25, 000 (plus Rs. 5,000 as costs of litigation).As a consequence of the deficient service and the repeated incompetency displayed by the employees, I have suffered undue hardship and mental frustration. I would like to emphasize that they have been grossly negligent in resolving my complaint. I have undergone a lot of extreme stress and mental agony. I want them to repaint at free of cost. And I need the assurance from them stating such thing will not occur in future
